1. Who you are dealing with
SabaGo is a delivery platform operated by MaxDeals (KvK 96472499), Duizendguldenkruid 3, 3137WB Vlaardingen, the Netherlands. Contact: support@sabago.app.
SabaGo is a trading name used by MaxDeals for this platform, it is not a separate legal entity. There is no separate Saba or Caribbean Netherlands registration for SabaGo.
By placing an order you accept these terms. If you do not accept them, do not place an order.
2. What SabaGo does, and does not do
We are the platform between you and a restaurant. The restaurant prepares your food and is responsible for it, including its quality, its ingredients, its allergen information and its compliance with food safety rules. We handle the delivery, using independent riders who work with us.
We are not a restaurant and we do not cook. If your food is wrong, cold or missing an item, tell us anyway, because we will sort it out with you and take it up with the restaurant.
3. Placing an order
You need an account, a working phone number, and a delivery location. Saba has no usable street addresses, so you set your delivery point as a pin on a map, with an optional landmark note. Put the pin where you actually want the food. If the pin is wrong or unreachable and the rider cannot deliver, we may charge you for the order.
A restaurant can decline an order, for example when the kitchen is full or an item has run out. If it does, you are not charged.
4. Prices, fees and taxes
Menu prices are set by the restaurant and are the same prices it charges in the restaurant.
On top of the item total you pay:
- a delivery fee, which depends on the distance between the restaurant and your pin;
- a service fee, calculated as a percentage of the item total;
- ABB (Saba spending tax) where it applies, at the rate set by law;
- a tip, if you choose to leave one. The rider receives every tip in full.
Every amount is shown to you before you confirm, and we calculate the total on our server.
5. Paying
You pay by card through Stripe, in US dollars. We authorise the amount when you place the order and take it when the restaurant accepts. If the restaurant declines or we cancel, the authorisation is released.
Where store credit or a voucher applies, it is deducted before your card is charged.
6. Cancelling, refunds and things going wrong
Before the restaurant accepts, you can cancel and pay nothing.
After the restaurant has started cooking, we cannot usually cancel, because the food is already being made. Contact us anyway and we will look at it.
If your order arrives damaged, incomplete or unreasonably late, contact us within 48 hours at support@sabago.app with your order number. Depending on what happened we will refund you in full or in part, or give you store credit. We decide this case by case and we try to be fair rather than technical about it.
7. Delivery
We give an estimated delivery time. It is an estimate, not a promise. Weather, terrain and how busy a kitchen is all move it.
Someone has to be reachable at the delivery point. The rider may ask for a confirmation code shown in your app. If nobody answers and we cannot reach you by phone, the rider waits 10 minutes and then leaves, you are still charged.
8. Your account
Keep your login to yourself. Give us accurate details. Do not use SabaGo to harass anyone, to place false orders, or to abuse riders or restaurant staff. We may suspend or close an account that does.
9. Reviews and content
If you leave a review, keep it about your own experience. We may remove content that is abusive, untrue, or has nothing to do with an order. By posting, you let us show it in the app.
10. Liability
We are liable for our own failures, and we take that seriously. We are not liable for the food itself, which is the restaurant’s responsibility, or for losses we could not reasonably have foreseen. Nothing here limits any liability that the law does not allow us to limit.
11. Changes
We may change these terms. If a change matters, we will say so in the app or by email. The terms that apply to your order are the ones in force when you place it.
12. Law and disputes
These terms are governed by the law of the Netherlands. The competent court still needs to be set once a lawyer has reviewed this section, so nothing in this section should be treated as final.
